Great news for sellers who finance in Texas: Texas Department of Savings &#038; Mortgage Lending Commissioner Doug Foster has issued a notice that allows the continuation of the de minimis exemption until further action is taken by the Legislature. This exemption, which was briefly repealed by the federal SAFE Act, means that a seller can once again finance up to five properties in a 12-month period without being licensed as a residential mortgage loan originator. The Texas Association of REALTORS® worked closely with the agency in its efforts to continue to allow the exemption to apply in Texas.</p>
<p>The de minimis exemption has not yet been recodified, but the Texas Association of REALTORS® will continue to work during the next legislative session to see that it is reinstated in statute. </p>

<td valign="top">There are many benefits to living in the greater Houston area, like the lively nightlife, the many restaurants, and being only 30 minutes from the beach.  Consequently, with the joy of the coast also comes the serious threat of hurricanes.  We all experienced the wrath of Ike and suffered a great deal of damage.  Thanks to the Red Cross, here is a list of things to be aware of during hurricane season that could help avoid a hurricane headache.  </p>
<p> <strong><span style="text-decoration: underline;">Watch vs. Warning:</span></strong></p>
<ul>
<li>Watch: Hurricane conditions are possible</li>
<li>Warning: Hurricane conditions are expected</li>
</ul>
<p><strong><span style="text-decoration: underline;">Prepare a Personal Evacuation Plan:</span></strong></p>
<ul>
<li>Identify ahead of time where you would go in the case of an evacuation.</li>
<li>Keep handy telephone numbers and a map of the place.</li>
<li>Listen to NOAA Weather radio or local radio stations for evacuation instructions.</li>
</ul>
<p><strong><span style="text-decoration: underline;">Assemble a Disaster Supplies Kit: </span></strong></p>
<ul>
<li>First aid kit and essential medications</li>
<li>Canned food and a can opener</li>
<li>At least 3 gallons of water</li>
<li>Protective clothing, sleeping bags, and bedding</li>
<li>Battery-powered radios, flashlight, and extra batteries</li>
<li>Important documents: driver&#8217;s licenses, social security cards, wills, deeds, etc.</li>
</ul>
<p><strong><span style="text-decoration: underline;">Prepare you home: </span></strong></p>
<ul>
<li>Install hurricane shutters or purchase pre-cut plywood for all your windows</li>
<li>Make trees wind resistant by removing damaged or dead limbs</li>
<li>Bring any lawn furniture, children&#8217;s toys, hanging plants, or trash cans</li>
<li>Recheck manufactured home tie-downs</li>
<li>Fill your car&#8217;s gas tank</li>
</ul>
<p><strong><span style="text-decoration: underline;">What to do when a hurricane warning is issued:</span></strong></p>
<ul>
<li>Listen to the officials, and leave if they advise it</li>
<li>If you are not told to evacuate, stay indoors.</li>
<li>Be aware of the &#8220;eye&#8221; of the hurricane, this is only the sign that a hurricane is half over</li>
<li>Be cautious of tornadoes which can happen during or after a hurricane.  Stay safe inside a room or bathroom with no windows.</li>
<li>Stay away from flood areas; rising waters are usually strong and swift and can easily sweep away you or your car.</li>
</ul>
<p><strong><span style="text-decoration: underline;">What to do after a hurricane: </span></strong></p>
<ul>
<li>Keep listening to the NOAA Weather station</li>
<li>Return home only when instructed to do so</li>
<li>Inspect your home for damage</li>
</ul>
<p>Hopefully, we will not have to put into practice these helpful strategies.  However, if a hurricane does make it&#8217;s way back to Houston, then you will know exactly what to do.  Have a great school year!</td>

In the process, you’ll learn how responsive – and organized – its members are.</p>
<p>1.	 What percentage of units is owner-occupied?  What percentage is tenant-occupied?  Generally, the higher the percentage of owner-occupied units, the more marketable the units will be at resale.<br />
2.	What covenants, by laws, and restrictions govern the property?  What grandfather clauses are in place?  You may find, for instance, that those who buy a property after a certain date can’t rent out their units, but buyers who bought earlier can.  Ask for a copy of the bylaws to determine if you can live within them.  And have an attorney review property docs, including the master deed, for you.<br />
3.	How much does the association keep in reserve?  How is that money being invested?<br />
4.	Are association assessments keeping pace with the annual rate of inflation?  Smart boards raise assessments a certain percentage each year to build reserves to fund future repairs.  To determine if the assessment is reasonable, compare the rate to others in the area.<br />
5.	What does and doesn’t the assessment cover – common area maintenance, recreational facilities, trash collection, etc.<br />
6.	What special assessments have been mandated in the past 5 years?  How much was each owner responsible for?  Some special assessments are unavoidable.  But repeated, expensive assessments could be a red flag about the condition of the building or the board’s fiscal policy.<br />
7.	How much turnover occurs in the building?<br />
8.	Is the project in litigation?  If the builders or homeowners are involved in a lawsuit, reserves can be depleted quickly.<br />
9.	Is the developer reputable?  Find out what other projects the developer has built and visit one if you can.  Ask residents about their perceptions.  Request an engineer’s report for developments that have been reconverted from other uses to determine what shape the building is in.  If the roof, windows, and bricks aren’t in good repair, they become your problem once you buy.<br />
10.	Are multiple associations involved in the property?  In very large developments, umbrella associations, as well as the smaller association into which you’re buying, may require separate assessments.</p>

<p>Quick Fixes for new-looking carpets</p>
<p>•	First, to really get it clean, sweep the carpet with a brook, which will make the nap stand up and loosen embedded dirt.  Next, vaccum the carpet.  Your carpet should show a noticeable improvement just from taking these two steps.<br />
•	If you have pets and need help neutralizing strong odors, mix one cup Borax with two cups cornmeal.  Sprinkle the carpet with this mixture.  Let stand one hour, then vaccum.  To freshen the carpet, combine three-quarters of a cup baking soda, two tablespoons cornstarch, and one-quarter cup perfumed talcum powder.  Sprinkle on dry carpet, let stand five to 15 minutes, then vacuum.</p>
<p>Spot-cleaning tips</p>
<p>DO<br />
•	Use a clean white, absorbent terry towel<br />
•	Blot or tamp the spot<br />
•	Pretest the carpet in an inconspicuous area<br />
•	Clean the stain from the edge to the center<br />
•	Apply cleaner to the  towel<br />
•	Clean with modest amounts of cleaning solution<br />
•	Adhere to product safety guidelines and general instructions<br />
•	Remove the stain as soon as it is noticed<br />
•	Remove the dirt excess before cleaning<br />
•	Use cleaning compounds at lukewarm temperature</p>
<p>DON’T<br />
•	Saturate the carpet with cleaning compounds<br />
•	Apply heat or vigorously scrub the stain<br />
•	Leave the stain until later<br />
•	Fail to remove dried excess stain prior to cleaning<br />
•	Forget to pre-test the carpet or stain</p>
<p>Follow these tips, and your carpet will look good as new again in no time.</p>

Raise your deductible – if you can afford to pay more toward a loss that occurs, your premiums will be lower.<br />
2.	Buy your homeowners and auto policies from the same company – you’ll usually qualify for a discount.  But make sure that the savings really yields the lowest price.<br />
3.	Make your home less susceptible to damage – keep roofs and drains in good repair.  Retrofir your house to prtect against natural disasters common to your area.<br />
4.	Keep your home safer – install smoke detectors, burglar alarms, and dead-bolt locks.  All of these will usually qualify for a discount.<br />
5.	Be sure you insure your house for the correct amount – remember, you’re covering replacement, not market value.<br />
6.	Ask about other discounts – for example, retirees who are home more than working people may qualify for a discount on theft insurance.<br />
7.	Stay with the same insurer – especially in today’s tight insurance market, your current vendor is more likely to give you a good price.<br />
8.	See if you belong to any groups – associations, alumni groups – that offer lower insurance rates.<br />
9.	Review your policy limits and the value of your home and possessions annually – some items depreciate and may not need as much coverage.<br />
10.	See if there’s a government-backed insurance plan – in some high-risk areas, such as the coasts, federal or state governments may back plans to lower rates.  Ask your agent.</p>

<p>1.	 House is overpriced…you need a new market analysis to see how much to lower the price<br />

3.	New competition since property listed…you need a new market analysis and lower the price and offer incentives<br />
4.	Builder competition…new market analysis, offer upgrades competitive with the builder<br />
5.	Difficult to show, not readily accessible…use lockbox and readjust showing hours if necessary<br />
6.	Glutted or slow market…adjust pricing and offer incentives<br />
7.	Property has become shopworn…add new photos, offer incentive, inform area Realtors<br />
8.	Many showings, but no offers…reduce price<br />
9.	Offers forthcoming but not consummated…re-examine counter offers and adjust to offers<br />
10.	Condition (maintenance problems)…freshen up and review ways to improve<br />
11.	Condition (major problems)…rehab as necessary with new carpet, paint, etc.<br />
12.	Cosmetic allowances have not enticed offer…rehab as necessary and remove allowance<br />
13.	Location not desirable…compensate with price adjustment<br />
14.	Property showcased poorly&#8230;hire staging professional or ask Realtor for suggestions<br />
15.	Property not being shown…make property more accessible with lockbox<br />
16.	Pets (odors, soil, intimidation)…deodorize carpet, cage pets when not home, kennel pets or put with a friend or relative until home sells<br />
17.	Neighbors or neighborhood undesirable…counsel with neighbors regarding interference and condition of their properties<br />
18.	External influence (new highways, etc.)…adjust price, gather accurate data, and prepare fact sheets for people interested in the home</p>

<p>7.  How close were the asking prices and the sales prices of homes selling in my neighborhood over the past three to six months.</p>
<p>8.  What designations do you hold?  Designations are additional real estate training the REALTOR has been through.  This is considered specialized training that is only help by one quarter of real estate agents.</p>
